Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian. You may use the Service only if you can form a binding contract and are not barred from doing so under applicable law.

Accounts and security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate registration information and keep it current. You agree to notify us promptly of unauthorized use.

You may maintain only one personal account unless we expressly authorize otherwise. Creating additional accounts to evade restrictions, manipulate ratings, or misrepresent identity is prohibited and may result in termination of all related accounts.

The Service

ItsMyScene is a community platform for discovering and documenting local live music — including venues, bands, shows, photo albums, articles, messageboard discussions, ratings, and related content. We may add, change, or remove features at any time.

Much of the information on the Service is submitted by users. We do not guarantee the accuracy, completeness, or timeliness of user-submitted listings, show times, venue details, or editorial content. Verify important details (for example ticket availability, door times, or age restrictions) with the venue, promoter, or artist before you rely on them.

Your content

You retain ownership of content you submit. By posting content on the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and adapt that content solely to operate, promote, and improve the Service. This license ends when your content is deleted from our systems, except where retention is required for legal, safety, or backup purposes.

You represent that you have the rights needed to post your content and that your content does not violate these Terms or applicable law.

Acceptable use

You agree not to:

• Post unlawful, harassing, hateful, threatening, defamatory, obscene, sexually exploitative, or otherwise objectionable content.
• Upload content you do not have the right to share, including copyrighted material you do not own or lack permission to use.
• Impersonate any person or entity, or misrepresent your affiliation.
• Spam, scrape, or use automated means to access the Service without permission.
• Attempt to probe, scan, or test the vulnerability of the Service or circumvent security or rate limits.
• Manipulate ratings, reviews, follows, or rankings through fake accounts, coordinated inauthentic behavior, or other deceptive practices.
• Use the Service for commercial solicitation unrelated to legitimate scene activity without our consent.
• Collect personal information about other users without their consent.

Bands, venues, shows, and claims

Users may create or help manage pages for bands, venues, shows, and related entities. If you claim or manage an entity page, you represent that you are authorized to do so. We may remove claims, transfer management, or require verification at our discretion.

Venue operators and band representatives are responsible for the accuracy of the information they publish and for complying with applicable laws, including those relating to advertising, accessibility, and ticket sales.

Moderation and enforcement

We may review, remove, restrict, or disable content or accounts that violate these Terms, our community guidelines, or applicable law. We may use automated tools, including AI-assisted moderation, as part of this process.

We may suspend or terminate accounts, including permanently banning users who create multiple accounts, submit false reports, or engage in serious or repeated abuse. Enforcement decisions are made in our reasonable discretion.

Third-party links and services

The Service may link to third-party websites, ticketing platforms, social profiles submitted by users, or news sources aggregated in The Wire. We do not control and are not responsible for third-party services. Your use of third-party services is at your own risk and subject to their terms.

AI-generated and automated content

Some features generate automated text or suggestions (for example scene summaries or assistant responses). Such output may be inaccurate or incomplete. It is provided for convenience only and should not be relied on as professional, legal, or safety advice.

Our intellectual property

The Service, including its design, branding, software, and original materials (excluding user content), is owned by us or our licensors and is protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.

Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, for conduct that we believe violates these Terms or harms the Service or other users. Provisions that by their nature should survive termination will survive.

Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. You agree that exclusive jurisdiction for disputes arising from these Terms or the Service will lie in the state or federal courts located in Florida, and you consent to personal jurisdiction there.

Before filing a claim, you agree to contact us at the address below and attempt to resolve the dispute informally.

Changes to these Terms

We may modify these Terms from time to time. When we do, we will update the "Last updated" date. Material changes may be announced on the Service or by email where appropriate. Continued use after changes become effective constitutes acceptance of the revised Terms.
